1st World Outgames - Montréal 2006

Please read these Terms and Conditions of Registration for the 1t World Outgames - Montréal 2006. You must agree to these Terms and Conditions when you register to participate in any role in the 1st World Outgames Montréal 2006.

By agreeing to these Terms and Conditions, you also automatically acknowledge that you understand and agree to comply with the specific policies related to your activity, the use of this web site or any other specific conditions you may have declared trough the registration process.

The 1st World Outgames - Montréal 2006, is organised by Comité organisateur des Jeux - Montréal 2006, a non-profit company registered in the Province of Québec, Canada, referred to hereafter as "Montréal 2006".

Terms and Conditions
a. I agree to abide by the rules and regulations of the 1st World Outgames - Montréal 2006 events as determined by Montréal 2006 and governing bodies for sport, conference and cultural events including all written and verbal instructions which may be given by Montréal 2006-designated officials and event managers. I accept that decisions of Montréal 2006 (including on matters referred to in these terms and conditions), judges and tournament officials are final.

b. I am 18 years of age or over and have the authority and the right to enter into this agreement and to be bound by these terms and conditions.

c. Montréal 2006 reserves the right to have officially-designated officials reclassify sports, cultural and conference participants where the registrant has self-selected a grade, level, category, division or other classification. Montréal 2006 reserves the right to combine or eliminate grades, levels, categories, divisions, or other classifications if it deems necessary at its complete and sole discretion.

d. Events for the Montréal 2006 games may proceed in all weather conditions provided Montréal 2006 and event officials determine, at their sole discretion, that it is safe to do so.

e. Montréal 2006 reserves the right to change venues, competition days and schedules of events and to cancel events at its complete and sole discretion.

f. I accept that some venues and facilities used by the Montréal 2006 may impose conditions of entry and other restrictions, and I will accept and abide by any such conditions or restrictions.

g. I declare that I am in a physically fit and healthy state required for participation in events of the Montréal 2006 for which I am registering, and that I am not aware of any serious medical condition that would prevent me participating in these physical activities. (For clarification, it is agreed that having been diagnosed as HIV positive is not considered a "serious medical condition" for the purposes of this clause.)

h. I agree not to act in a way that would compete with or devalue the Montréal 2006 and Gay & Lesbian International Sport Association (GLISA) sponsors' rights regarding branding potential, logo rights, exclusive presence, etc. at venues where events are being staged. If at any time during the event, officials designated by Montréal 2006 determine, at their sole discretion, that my actions may result in the devaluation of said sponsor rights or competes with the event sponsors, I will be required to immediately cease such action, including the removal of any uniforms, signs or other items that compete with sponsor or potentially devalues such sponsorship.

i. I agree not to make any unauthorised use of the Montréal 2006 logo or trade marks including "Comité organisateur Montréal 2006", " 1st World Outgames - Montréal 2006, Gay and lesbian sport and cultural Festival " or any variation on these, on personal or team uniforms/clothing, merchandise or promotional material and to abide by Montréal 2006's policies governing use of logos and trade names.

j. If I sustain an injury or illness while participating in any role in the1st World Outgames - Montréal 2006, I hereby authorise medical personnel to perform and administer first aid medical treatment as deemed necessary and to seek more specialised medical attention at hospitals and health care institutions if deemed necessary by first aid and medical staff of Montréal 2006.

k. I agree that I have been advised to acquire adequate personal accident and health care insurance as a participant in any role, registrant of 1st World Outgames - Montréal 2006. I accept that it is my responsibility to organise my own travel and personal accident insurance to cover myself and my property for the whole period of the 1st World Outgames - Montréal 2006.

l. Montréal 2006 will present non-precious metal, gold, silver and bronze coloured medals to the first, second and third place winners respectively as described in the competition rules for each sport and cultural event where medals are awarded, regardless of the number of participants in each of the medalled levels, grades, or divisions, unless otherwise provided by sanctioning rules for the sport. The collapsing of levels, grades and divisions or age groups will not affect medals awarded in accordance with the rules of a particular sport.

m. I understand that as part of the Registration and Accreditation process of the 1st World Outgames - Montréal 2006, personal information is being collected by Montréal 2006. I consent to the collection, use and disclosure of my personal information for the purpose of enabling my participation in the sports, conference and cultural program of the 1st World Outgames - Montréal 2006; and for the purpose of receiving information related to my participation in this event from Montréal 2006 in the form of printed newsletters, electronic newsletters, promotional flyers and other communication media.

n. I give my consent to Montréal 2006 to the disclose my personal information to third parties involved, on behalf of Montréal 2006, in the organisation of the 1st World Outgames - Montréal 2006 and to the Gay and Lesbian International Sport Association (GLISA) for the purposes of promoting future World Outgames and for promoting future events of GLISA's member associations.

o. I agree that failure to comply with the official instructions, rules and regulations of Montréal 2006 or governing bodies for sports, conference and culture events may result in immediate disqualification for events or from the games.

p.These Terms and Conditions shall be governed by the laws of the Canada, and actions arising hereunder or relating hereto shall be brought in a court of competent jurisdiction in the Province of Québec, Canada.

q. AUTHORIZATION AND RELEASE

In consideration of the acceptance of my registration to participate in any role in the 1st  World Outgames - Montréal 2006, I hereby grant to the Comité organisateur des Jeux Montréal 2006 and the Gay & Lesbian International Sport Association (GLISA) and their respective subsidiaries, affiliates, successors, assigns as well as to such other persons as they may designate from time to time and namely to the Canadian Broadcasting Corporation/ Société Radio-Canada (collectively the "Authorized Parties"), the following perpetual, worldwide and irrevocable authorizations and release in connection with my participation in and presence at The 1st World Outgames - Montréal 2006 (including but not limited to any performance that I may give whether athletic or artistic).

i) General Authorization and Release for all Participants
The Authorized Parties shall have the absolute right and permission (but not the obligation) to use in perpetuity, my name, likeness, voice and biographical and photographic material (including still or moving image(s) of me, either alone or accompanied by other persons or material), in any manner and in any media without restriction as to number of uses, throughout the world, for the purpose of promoting, publicizing, advertising and exploiting the 1st World Outgames - Montréal 2006, future Outgames or similar events and the respective activities of the Authorized Parties. This shall include any archiving, exhibition, communication to the public and distribution in any market by any means of telecommunication or distribution whatsoever, now known or later discovered and namely without limitation any exhibition, communication and distribution by means of Internet, motion pictures, photographs, radio, television, video discs, tapes and cassettes, DVDs or any print media.

I hereby acknowledge that Authorized Parties may proceed at their sole and complete discretion with any use of my name, likeness, voice and biographical and photographic material without giving me prior notice or receiving my approval.

I expressly release the Authorized Parties and their respective agents, employees, independent contractors and/or other representatives, successors and assigns from and against any and all claims for invasion of privacy, rights of publicity, defamation or any other cause of action arising out of Authorized Parties' use of my name, likeness, voice and biographical and photographic material for the purposes described in the present General Authorization and Release for All Participants, including without limitation what I might deem to be a misrepresentation of me, my character or my person, whether or not due to any distortion, optical illusion or faulty reproduction which may occur.

ii) Authorization in respect of Artistic Performance(s)
Without limiting the generality of the above General Authorization and Release for All Participants, in respect of any Artistic Performance I may give at, or in connection with the 1st World Outgames - Montréal 2006, I also grant Authorized Parties the following perpetual and exclusive worldwide rights and waiver:

(1) to record or otherwise reproduce and archive by any means and in any support whatsoever, now known or later discovered, all or any part of my Artistic Performance;
(2) to exhibit, communicate to the public and distribute in any market my Artistic Performance or any part thereof by any means of telecommunication or distribution whatsoever, now known or later discovered; this includes without limitation any exhibition, communication and distribution by means of Internet, motion pictures, photographs, radio, television, video discs, tapes and cassettes, DVDs or any print media;
(3) to cut, edit, add to, subtract from, arrange, rearrange, shorten and revise my Artistic Performance in any manner as Authorized Parties may determine in their sole and complete discretion;
(4) to use my Artistic Performance in connection with the advertising and promotion of The 1st World Outgames - Montréal 2006, future Outgames or similar events and of the respective activities of the Authorized Parties;
(5) to assign and license others to so do; and
(6) I hereby irrevocably and unconditionally waive in perpetuity in respect of my Artistic Performance the benefits of any provision of law or treaty known as moral rights (or droit moral) whether now in force or later arising, and I hereby agree as a separate and independent undertaking not to institute, support, maintain, pursue or permit any action, lawsuit or legal proceedings in any part of the world on the ground that any of the subject matter of the rights granted herein in any way constitutes an infringement of any moral rights I may have or contains unauthorized variations, alterations, adaptations, modifications, changes or derogatory treatment of my Artistic Performance.

"Artistic Performance" shall include artistic performances of any kind and nature and shall not be limited to musical, instrumental, vocal or singing performances or other sound effects produced by me as well as any dance or theatrical performances.

Without limiting the generality of all authorizations given above, I hereby specifically consent to the use by the Authorized Parties, of my name, likeness, voice and biographical and photographic material in connection with my Artistic Performance at the 1st World Outgames - Montréal 2006 for the purpose of promoting, publicizing, advertising and exploiting the 1st World Outgames - Montréal 2006, future Outgames or similar events and the respective activities of the Authorized Parties.

iii) Miscellaneous
This Authorization and Release is granted free of charge for all uses and exploitations provided herein. By forwarding this Authorization and Release, I warrant and represent that I, along with my heirs, successors and assigns, will be bound by and adhere to its terms.

This Authorization and Release shall be governed and construed in accordance with the laws of the Province of Québec and the federal laws of Canada applicable therein. The Parties agree to attorn to the exclusive jurisdiction of the courts of the judicial district of Montréal, including the Federal Court of Canada.
